The services are operated by OceanSphere Service Sp. z o.o., ul. Nowogrodzka 31, 00-511 Warszawa, Poland (KRS 0001211680, NIP PL7011291111), "OceanSphere", "we". Our services are made for companies, self-employed professionals and public bodies in the maritime industry. By registering an account or sending a request you confirm that you act in the course of your business or profession and not as a consumer.
Reading the public parts of the sites is free. Some functions need a free account; some plans are paid (Part C). Contracts for field service, sourcing orders or software subscriptions are concluded separately; these terms govern the use of the websites and accounts. Orders for field service, supplies, technical consulting and custom software are subject to our General Terms of Business, which prevail over these terms for such orders.
You must give true and complete details when you register and keep them up to date. An account belongs to the company named in it and may be used by its employees; you are responsible for everything done with your login. Keep your password secret and tell us at once if you suspect misuse. We may refuse or close accounts that use free-mail addresses where a company address is required, that give false company details, or that belong to reserved or test domains. You can close your account at any time.
The technical data in the Library, in the equipment register and on listings are compiled from manufacturer publications, classification society records, user contributions and other public sources, partly with the help of automated systems. We do our best to keep them correct, but we cannot guarantee that a data sheet matches the unit installed on your vessel. Never base a safety-relevant decision on our data alone. Always check against the documentation of the specific unit and the instructions of the manufacturer and the classification society. Data marked as "unconfirmed" or "possible match" are the result of automated matching and have not been checked by a person.
You may use the services for your own business purposes. You may not (a) copy, crawl, scrape or systematically download our databases or substantial parts of them, whether manually or with software; (b) resell, sublicense or publish our data; (c) use the services to send unsolicited advertising; (d) try to circumvent access restrictions, rate limits or bot protection; (e) upload malware or content that infringes the rights of others. We block automated access that exceeds normal use and may suspend accounts that breach this section.
Where you upload content (listings, photos, documents, corrections, company profiles), you keep your rights in it. You grant us a non-exclusive, worldwide licence to store, reproduce, display, adapt for display, translate and distribute the content within the services and in search-engine previews, for as long as the content is published, and thereafter as needed for records and legal defence. You warrant that you have the rights to upload the content and that it does not infringe rights of third parties or the law. You must not upload photographs of identifiable persons without their permission.
We do not check user content before it is published. We remove or restrict content that is illegal or breaches these terms when we become aware of it. Anyone can report content to us through the report function shown on listings and profiles, or by e-mail to kontakt@oceansphere-service.com (please state the address of the content, why you consider it illegal or in breach, and your name and e-mail address). We confirm receipt, decide without undue delay and tell both the reporter and the uploader what we decided and why. If we remove your content, restrict your account or refuse a report, you can object by e-mail within six months; a person will review the decision. We do not use automated systems to take moderation decisions; automated systems only flag content for human review. Our decisions are taken diligently, objectively and proportionately. Members of the public and authorities can reach our single point of contact at the e-mail address above.
We may suspend or restrict an account with immediate effect where there is a serious breach of these terms, a legal obligation, a court or authority order, or repeated reports that turn out to be justified. In all other cases we give at least 30 days' notice before we terminate an account and state the reasons. You can terminate at any time. After termination we delete the account data as described in the privacy policy.
We provide the services as they are. We aim at high availability but do not guarantee uninterrupted access; maintenance, updates and attacks can cause interruptions. We may change or discontinue free functions. For paid plans, Part C applies.
We are liable without limitation for intent, gross negligence and for injury to life, body or health. For slight negligence we are liable only for the breach of essential contractual duties (duties whose fulfilment makes the proper performance of the contract possible in the first place) and then only for the foreseeable damage typical of the contract. We are not liable for the content of listings, profiles and other user content, nor for contracts you conclude with other users. Nothing in these terms limits liability that cannot be limited by law. This section A10 applies to the use of the websites, accounts and plans. Liability for field service, supplies, technical consulting and custom software is governed exclusively by section 4 of our General Terms of Business.
Polish law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The courts of Warsaw, Poland, have exclusive jurisdiction for disputes with companies. These terms exist in English, German and Polish; in case of doubt the English version prevails.
OceanSphere Parts is an online marketplace on which companies ("sellers") publish offers of spare parts and surplus stock and other companies ("buyers") can search and ask for quotes. OceanSphere is not a party to the sale between buyer and seller and does not own the goods offered, unless a listing or an offer expressly names OceanSphere Service Sp. z o.o. as the seller. Our sourcing desk may in addition procure parts on a buyer's request, and we may ourselves offer parts as seller; in both cases a separate order is concluded with us under our General Terms of Business (Part C).
Sellers register a company account. Before the "Verified seller" badge is shown, a person at OceanSphere checks the company on the basis of its e-mail domain and, where given, its VAT or register number (VAT numbers are validated with the VIES service of the European Commission). We may ask for further evidence. The badge means that we checked the identity of the company at the time of verification; it is not a guarantee of the seller's performance. Sellers must keep their details current and inform us when their company changes.
A listing must describe the actual part on offer: title, manufacturer, part or model number where known, condition, quantity, location, delivery term and, where stated, price. Photographs, where provided, must show the actual part; where no photograph is provided, the listing says "photos on request" and the seller must supply photographs to an interested buyer on request. Prices and availability are indicative and become binding only in the seller's quote. The following may not be listed: goods whose sale is prohibited or restricted by export-control or sanctions law without the required licence; counterfeit or falsely labelled parts; parts subject to a manufacturer's recall unless the recall is disclosed; goods the seller does not have the right to sell. Sellers must remove or mark as sold parts that are no longer available. Listings that are not confirmed for a long period are shown as "unconfirmed" and may be hidden.
A buyer sends an inquiry through the inquiry form of a listing. The inquiry reaches our trading desk, which forwards the technical request to the seller and, where the buyer asks for it, brings buyer and seller into direct contact. The seller's quote, the buyer's order and the contract of sale are concluded between buyer and seller under the terms they agree; the seller is responsible for its offer, delivery, conformity and invoicing. We may support with logistics or inspection under a separate agreement.
Publishing listings and sending inquiries is currently free of charge. We will announce fees, if we introduce any, at least 30 days in advance; listings published before the announcement remain free until they expire or are edited.
Search results and listing overviews are ordered by the following main parameters, in this order of weight: (1) relevance of the listing text to the search query (title, manufacturer, part number, description); (2) how recently the seller confirmed that the part is still available; (3) whether the seller is verified; (4) completeness of the listing (part number, photos, price). Listings can be filtered by category, condition and location. There is no paid placement. We do not favour our own listings over those of other sellers; when OceanSphere itself sells a part, this is stated on the listing.
The seller's company name is not shown on public listings; buyers see the location, the condition and the "Verified seller" badge. We tell the seller which company sent an inquiry only when the buyer asks for direct contact or when the seller needs it to prepare a quote. Sellers receive the technical content of an inquiry and, with the buyer's consent, the buyer's contact details. Both sides may use the data they receive only for the transaction concerned.
We may hide, restrict or remove a listing that breaches B3 or the law, or that is the subject of a justified report. We inform the seller of the decision, the facts and the reasons, and of the possibility to object (A7). In urgent cases (safety, sanctions, court order) we act first and inform afterwards. We may also require additional evidence of the seller's right to sell before a listing is restored.
Sellers can see and edit all their listings in their cockpit and receive, on request by e-mail, an export of their listings and inquiries in a machine-readable format. We keep aggregated marketplace statistics; we do not share one seller's inquiry data with other sellers.
A contact pack gives the buyer a number of contact credits. One credit unlocks the contact details (e-mail address, telephone number) of one company listed in Maritime Network, on screen or as part of a CSV export. Credits are bought once, do not expire and are not refunded once used. A company whose contact details were unlocked can be viewed and exported again without a further credit.
Data unlocked or exported under a contact pack or a plan may be used by the buyer for its own business development only: to contact the companies concerned with offers, enquiries and information related to the buyer's own products and services. The buyer may not resell, publish, sublicense, share with third parties or use the data to build or enrich a directory, database or marketing list for others. The buyer may not use the data to send messages that are unlawful at the recipient's location. We may suspend an account that breaches this section and no refund is due for unused credits in that case.
Contact details in Maritime Network are business contact data of companies. Where they identify a natural person (for example a named contact), the buyer becomes an independent controller under Article 4(7) of the General Data Protection Regulation for its own processing from the moment of export, is responsible for informing the persons concerned under Article 14 GDPR where required, for honouring objections, and for complying with the law on direct marketing at the recipient's location. We remain controller for the directory itself. Our Privacy policy explains how we compile the directory and how listed companies can correct or remove their entry.
Directory data are compiled from public sources and updated continuously, but we do not warrant that every contact detail is current. Section A4 applies. Credits used to unlock an entry whose e-mail address bounces as non-existent within 14 days are refunded on request in text form.
Paid plans (for example Work plans on oceansphere.io or directory plans on maritimenetwork.io) are described on the respective price page, which states the functions, the price, the billing period and the taxes. A plan starts when the order is placed and the first payment is received, and renews for the same period unless cancelled before the end of the current period. You can cancel at any time in your account or by e-mail; cancellation takes effect at the end of the current period, and periods already started are not refunded. Payments are processed by Stripe; invoices are issued by OceanSphere Service Sp. z o.o. and sent by e-mail. If a payment fails, we may suspend the paid functions after a reminder. We may change prices with at least 30 days' notice for the next period; you may cancel before the change takes effect. Where a plan is used by a company established in Poland, Polish VAT applies; for companies in other EU Member States the reverse-charge mechanism applies when a valid VAT number is given.
